Delhi HC Slams KVS: KVS fails to fulfill HC recruitment orders for special teachers


Recently in a legal development, the Delhi High Court has expressed serious dissatisfaction with the Central Vidyala Sangathan (KVS) to fail to follow the court order regarding the recruitment of special teachers. Failure to recruit and appoint qualified special teachers has raised concerns, especially affecting the education (CWSN) of children with special needs in Kandriya Vidya. The legal case has reached the mild issues of non-transportation with court instructions, and KVS is now facing serious legal consequences.

On 5 August 2024, the Delhi High Court passed an order in WP (C) 5916/2022, directed the KVS to immediately start the recruitment process for special teachers. The court directed the construction of 987 posts for special teachers, especially, as approved by the Ministry of Finance and Expenditure. After this the recruitment rules were to be followed, and the appointment process was to be completed within six months.

However, despite the clear instructions, the KVS failed to start the recruitment process within the stipulated time frame, which has now led to legal action. The absence of special teachers in KVS schools is harmful to the education of CWSN students, who rely on trained professionals to support proper learning.

Failure to follow the orders of the High Court has strongly condemned Ashok Aggarwal, a lawyer representing the petitioners in the case. In a legal notice on 13 February 2025, Aggarwal accused KV of deliberately ignoring the court’s directive. He emphasized that the lack of action forms the contempt of the court, a legal term that refers to any action that weakens or disregard the rights or orders of a court.

Notice especially highlights the pain of CWSN students, whose education is compromised due to the absence of particular teachers. The court order was clear: KVS was to complete the recruitment within six months, yet no progress has been made. This inaction is seen as a barrier to ensure direct violations of court rights and inclusive education.

KVS Commissioner, Mrs. Nidhi Pandey has important implications in the legal notice sent. If the KVS continues to ignore the order of the court, it risks to face contempt proceedings. The notice also shows that the education of CWSN students is being severely affected, which may lead to more legal action to ensure that the rights of these students are protected for education.

KVS has been given a clear opportunity to follow the directions of the court. However, if they fail to work, the results can only be beyond legal punishment, affecting public belief and institution’s reputation. Meanwhile, the KVS exam is also expected to be conducted soon for the recruitment of 15,000 teachers in 2025.
