The Supreme Court of India has upheld the Calcutta High Court’s decision to cancel the appointment of more than 25,000 teachers and non-teaching employees admitted through the West Bengal School Services Commission (WBSSC) in 2016. This decision is a major setback for the West Bengal government led by Mamta Banerjee, demanding the High Court’s decision to be reversed.

The Supreme Court, led by Chief Justice Sanjeev Khanna and Justice PV Sanjay Kumar, found that large -scale irregularities had stained the recruitment process. The court ruled that the selection process lacked credibility and validity, which made the appointments unstable. It was emphasized that the means of fraud were employed to manipulate the recruitment process, thus violating constitutional principles of fairness and equality.
Despite the separation of tainted and unpounted candidates of the state government, the Supreme Court rejected the argument, deciding that all appointments made through the procedure should be abolished. The court said that even those who were not directly implicated in the activities of fraud, could not retain their jobs as the entire recruitment exercise was compromised.
Why did SC nullify WB Teacher Recruitment Process 2016?
Case arising from the recruitment process conducted through State Level Selection Test (SLST) -2016. More than 23 lakh candidates had applied for 24,640 vacancies, yet 25,753 appointment letters were issued. The investigation widely highlighted misconduct, including OMR sheet and rank-jumping manipulation.
The Calcutta High Court had earlier ruled that the selection process had violated articles 14 and 16 of the Indian Constitution, which guarantees equality in public employment. The Supreme Court upheld this decision citing clear evidence of manipulation and fraud practices in the recruitment process.
SC order fresh WB teacher recruitment soon
The Supreme Court has directed the West Bengal government to conduct a new recruitment process within three months. Therefore, candidates may expect a new notification for West Bengal Teacher Recruitment 2025, soon SC clarified that candidates who successfully qualify in the new selection process will not need to return the salary prepared since the 2016 appointments. However, those who fail to clean the fresh selection will have to return the salary received.
Additionally, the court provided special relief for persons with disabilities, allowing them to maintain their current appointments. The Central Bureau of Investigation (CBI) has been tasked to continue its investigation in the fraud recruitment process.
